Weston man gets credit for time served

A Weston man was given credit for time served in jail prior to entering his plea for the crime of fleeing from police.
Brian K. Bevans, 29, of Forinash Road, fled from Deputy Z.M. Lopez of the Lewis County Sheriff’s Department last March. He was charged with the offense by Prosecuting Attorney Christina Flanigan on May 3 as part of a plea agreement.
On May 3, he pleaded no contest before Magistrate Michael R. Gissy who assessed court costs of $160.25 and gave him credit for 11 days spent in jail prior to entering his plea.
Other recent dispositions handed in Lewis County Magistrate Court included:
Harvey B. John, 56, of West Second Street, was charged with petit larceny by Ptlm. S. Carlton, WPD, on Aug. 15 of last year. He was charged with possession of a controlled substance/Marijuana by Deputy E.E. Carpenter, LCSD, on Sept. 5 of last year and with obstructing by Deputy J.S. VanMeter, LCSD, on Oct. 26 of last year.
On May 3, under a plea agreement with the state, John pleaded no contest to petit larceny for the theft of items from the Weston Go Mart. By motion of the state, the possession and obstructing charges were dismissed by Magistrate Gissy.
On the petit larceny conviction he was assessed court costs of $160.25 and received a suspended 60-day jail sentence replaced with one year of probation.
Janya L. Jeffries, 27, of Water Street, Weston, was charged with possession of a controlled substance/Methamphetamine by Sr. Tpr. F.J. Turansky, WVSP, on April 14.
On May 3, Jeffries pleaded guilty before Magistrate Gissy. She was assessed court costs of $160.25 and received a suspended 90 day jail sentence replaced with one year of probation. She received credit for 20 days spent in jail prior to entering her plea.
Zachary D. Wolfe, 24, of Monongalia Street, Buckhannon, had his probation revoked by Magistrate Gissy on May 3, on a conviction for obstructing the police. He will serve the remainder of his original sentence, which equals 10 days, in jail. He had previously been sanctioned on Feb. 22, with 50 days in jail for violating his probation.
Gerald D. Yoder, 29, of Laurel Lick Road, Weston, was charged with domestic assault by Deputy B.D. Hendershot, LCSD, on Nov. 5, 2017.
On May 3, upon motion by the state, the charge was dismissed by Magistrate Gissy with the notation that the dismissal was at the request of the victim.
Christopher L.  Burr, 28, of Bablin Ingo Road, Crawford, was charged with domestic battery by Deputy J.S. Tonkin, LCSD, on June 29, 2017.
On May 3, upon motion by the state, the charge was dismissed by Magistrate Gissy with the notation that the dismissal was the result of the discretion of the assistant protecting attorney not to prosecute.
