Webster man fined for TALA break in

A Webster Springs man has been fined after he had a felony breaking and entering charge against him dismissed in Lewis County Magistrate Court.
Corey W. Cowger, 20, of Excelsior Road, Webster Springs, was originally charged with felony breaking and entering into the Trans Allegheny Lunatic Asylum, along with two others, on July 4, 2017, by Weston officer J.I. Minney.
On Dec. 21, 2017,  under a plea agreement with the state, Cowger pleaded guilty to a reduced misdemeanor charge of destruction of property before Magistrate Michael R. Gissy.
He was assessed a fine of $200, court costs of $160.25 and was ordered to pay restitution in the amount of $12.50 for damage to a door.
Brandlee O. Short, 21, and Steven J. Johns, 27, both of Cowen, previously pleaded guilty to trespassing and destruction of property, respectively, for the TALA crimes.
Other recent judgments handed down in Lewis County Magistrate Court included:
Trevor M. Butcher, 24, of Hickory Lane, Weston, was charged with domestic battery by Deputy J.S. Tonkin, LCSD, on July 7, 2017.
On Dec. 27, 2017, the charge was dismissed upon motion by the defense, without objection by the state, before Gissy with the notation:“failure to timely prosecute.”
Ryan L. Williams, 22, of Kuntz Drive, Weston, was charged with battery by Deputy B.D. Hendershot, LCSD, on May 28, 2017.
On Dec. 28, 2017, the charge was dismissed upon motion by the state before Magistrate Roger D. Clem, Jr., with the notation that Williams, “successfully completed a pretrial diversion program.”
Kelli J. Tucker, 34, of West 4th Street, Weston, was charged with giving false information to the police by Sr. Tpr. F.J. Turansky, WVSP, Dec. 8, 2017.
On Dec. 28, 2017, Tucker pleaded guilty before Magistrate Clem. She was assessed court costs of $160.25 and was given credit for 20 days served in jail prior to entering her plea.
Keesha D. Gordon, 38, of Mikee Road, Pricetown, was charged with obstructing the police in connection with a stolen vehicle investigation by Deputy  J.R. Moran, LCSD, on May 12, 2017.
On Dec. 27, 2017  Gordon pleaded guilty before Gissy. She was assessed court costs and was sentenced to serve 30 days in jail with credit for any time she served prior to entering her plea.
David J. Boggs II, 39, of Bunners Ridge Road, Fairmont, was charged with possession of a controlled substance/Methamphetamine by Deputy J.S. Carey, LCSD, on Oct. 4, 2017.
On Dec. 27, 2017, Boggs pleaded no contest before Gissy. He was assessed court costs of $160.25 and received a 90-day jail sentence, with credit for 85 days served in jail prior to entering his plea, with five days suspended and replaced with one year of probation.
Chad D. McDonald, 30, of Maple Avenue, Philippi, was charged with domestic battery by Ptlm. K.P. Moneypenney, WPD, on June 28, 2016.
On Dec. 27, 2017, McDonald pleaded no contest before Gissy. He was assessed court costs of $160.25 and received a 30-day jail sentence with credit for 20 days served in jail prior to entering his plea.
Jessica D. Montgomery, 33, of Westwood Drive, Jane Lew, was charged with obstructing the police by Deputy J.S. Van Meter, LCSD, on Sept. 15, 2017.
On Dec. 27, 2017, Montgomery pleaded guilty before Magistrate Clem. She was assessed court costs of $160.25 and received a 10-day jail sentence, with credit for one day spent in jail prior to entering her plea, with nine days suspended and replaced with six months of probation.
Zachary M. Mealey, 25, of Virginia Street, Jane Lew, was charged with domestic assault by Asst. Prosecuting Attorney J.C. Clevenger on June 21, 2017.
On June 21, 2017, Mealey pleaded guilty before Magistrate Clem. He was assessed court costs of $160.25 and received a 90-day suspended jail sentence replaced with one year of probation to include participation in the Community Corrections Program.
On Dec. 20, 2017, Mealey’s probation was revoked upon motion by the state before Magistrate Clem and he was sentenced to serve the 90-day jail sentence with credit for any time served prior to entering his plea. The revocation was for drug use, attempting to defeat drug screening, and associating with a known drug user all in violation of Community Corrections Program rules.
Ronnie L. Barfield, 26, of Alum Avenue, Weston, was charged with third offense driving while license was suspended or revoked/general, improper vehicle registration, possession of a controlled substance/Marijuana and no proof of vehicle insurance by Cpl. L.D. Mohr, WVSP, on Nov. 10, 2017.
On Dec. 21, under a plea agreement with the state, Barfield pleaded guilty to driving while license was suspended or revoked and improper vehicle registration and the  possession and no insurance charges were dismissed upon motion by the state before Gissy.
On the driving suspended/revoked charge, Barfield was assessed court costs of $160.25 and received a 30-day suspended jail sentence, with credit for seven days spent in jail prior to entering his plea.
On the improper registration charge he was assessed a fine of $250 and court costs of $160.25.
Michael A. Marcum, 40, of Upper Little Birch Road, Little Birch, was charged with possession of a controlled substance/Methamphetamine by Deputy Z.M. Lopez, on Aug. 10, 2017.
On Dec. 21, 2017, Marcum pleaded guilty before Gissy. He was assessed court costs of $192.05 and received a 90 day suspended jail sentence replaced with one year of probation with credit for 61 days served in jail prior to entering his plea.
Janette A. Tucker, 42, of Water Street, Weston, was charged with violation of a domestic violence protection order by Sr. Tpr. F.J. Turansky, WVSP, on Dec. 8, 2017.
On Dec. 21, Tucker pleaded guilty before Gissy. She was assessed a fine of $250, court costs of $160.25 and received credit for 14 days served in jail prior to entering her plea.
Jason T. Forney, 31, of Burns Street, Latrobe, Pa., was charged with improper vehicle registration and driving with a suspended or revoked license for DUI by Sr. Tpr. F.J. Turnansky, WVSP, on Dec. 16, 2017.
On Dec. 21, under a plea agreement with the state, Forney pleaded guilty to improper registration and a reduced charge of driving while his license was suspended or revoked/general before Gissy.
On the improper registration charge Forney was assessed a fine of $200, court costs of $160.25 and received credit for five days spent in jail prior to entering his plea.
On the driving revoked charge he was assessed court costs of $160.25.
Corey D. Tanner, 29, of Minnich Street, Weston, was charged with domestic assault by Chief J.P. Thomas, WPD, on Aug. 4, 2017 and with violating provisions of his bail, and unlawful taking of a vehicle by Ptlm. J.I. Minney, WPD, on Aug. 12, 2017.
On Dec. 18, under a plea agreement with the state, Tanner pleaded guilty to domestic assault and the unlawful taking of a vehicle and the bail violation and  improper vehicle  registration charges were dismissed upon motion by the state before Magistrate Clem.
On the domestic assault charge, Tanner was assessed court costs of $160.25 and received a 90-day suspended jail sentence with credit for 15 day served prior to entering his plea, replaced with 75 days of home confinement.
On the unlawful taking of a vehicle charged he was assessed court costs of $160.25 and received a 90-day suspended jail sentence with credit for 15 day served prior to entering his plea, replaced with 75 days of home confinement to  be served concurrently with the domestic assault sentence.
