Man pleads to DUI following three vehicle accident


Justin T. McGuire, 28, of Rush Run Road, Weston, was charged with driving under the influence of a controlled substance with bodily injury by Pltm. S. Carlton, of the Weston Police Department on Feb. 19.
McGuire was charged following a three vehicle accident that occurred on U.S. Route 33, near Domino’s Pizza in Weston at approximately 8 p.m. The accident sent one victim to the hospital.
In officer Carlton’s complaint against McGuire he wrote that he was assisted at the scene of the accident by Deputy Carpenter of the Lewis County Sheriff’s Department. Carlton stated that McGuire indicated he must have fallen asleep at the wheel and sideswiped one vehicle and hit another vehicle head on.
At the scene, the complaint states that McGuire exhibited signs of being under the influence of either drugs or alcohol and failed three of five field sobriety tests but did not register any alcohol content on the preliminary breath test.
He consented to a blood test, which was administered at Stonewall Jackson Memorial Hospital after he was taken into custody.  
On April 25, McGuire pleaded guilty to the charge before Magistrate Michael R. Gissy.
He was assessed a fine of $200, court costs of $255.25, and was given credit for 66 days spent in jail prior to entering his plea as his jail sentence.
Other criminal dispositions handed down recently in Lewis County Magistrate Court included:
Angelena D. Roach, 35, of West Second Street, Weston, was charged with driving while license was suspended or revoked for general reasons by Ptlm. J.I. Minney, WPD, on March 20.
On April 26, Roach pleaded guilty before Magistrate Roger D.  Clem, Jr.  She was assessed a fine of $100 and court costs of $160.25.
Carl R. Anderson, Jr., 41, of Chestnut Avenue, Clarksburg, was charged with domestic battery, disorderly conduct, and public intoxication by Ptlm. B. Newbrough, WPD, on April 14.
On April 26, under a plea agreement with the state, Anderson pleaded guilty to domestic battery and public intoxication and the disorderly conduct charge, was dismissed upon motion by the state before Magistrate Clem.
On the domestic battery charge, Anderson was assessed court costs of $160.25 and received a 30 day jail sentence which was suspended. On the public intoxication charge he was assessed  a fine of $5 and court costs of $160.25.
Michael T. Deien, 37, of Heavenly Meadow Lane, Bridgeport, was charged with a no wake violation by J.A. Parsons, DNR Officer, on April 23.
On April 26, Deien was found guilty by Magistrate Clem and was assessed a fine of $20 and court costs of $160.25.
Sandra N. Brown, 38, of South Main Avenue, Weston, was charged with failure to cause child to attend school by R. Myers, LC Schools Attendance Director, on April 20.
On April 26, Brown pleaded no contest before Magistrate Clem. She was assessed court costs of $185.25 and received a suspended 20 day jail sentence replaced with one year of probation, with the notation that should the child miss school, Brown will serve jail time on weekends.
Justin F. Kyer, 35, of Cottrill Run Road, Jane Lew, was charged with second offense violation of a domestic violence protection order on Nov. 20, 2017, by Deputy B.D. Hendershot, LCSD, and with the same violation by Deputy J.S. Carey, LCSD, on Jan. 18.
On April 25, under a plea ageement with the state, Kyer pleaded guilty to the Jan. 18 charge and the Nov. 20, 2017, charge was dismissed upon motion by the state before Magistrate Clem.
On the violaton of protection order, Kyer was asssessed court costs of $160.25 and received a nine-month suspended jail sentence replaced with one year of probation, with credit for 93 days spent in jail prior to entering his plea. As part of his probation he is to have no contact with the victims of his crime.
Jeffrey S. Fallo, 41, of North River Avenue, Weston, was charged with possession of a controlled substance/Marijuana and possession of a controlled substance/Methamphetamine by Deputy Z.M. Lopez, LCSD, on April 13.
On April 25, under a plea agreement with the state, Fallo pleaded guilty to the possession of meth charge and the possession of Marijuana charge was dismissed upon motion by the state before Magistrate Gissy.
On the possession of meth charge, he was assessed court costs of $160.25 and recieved a 90-day suspended jail sentence replaced with one year of probation to include Day Report Center participation. He received credit for 13 days spent in jail prior to entering his plea.
Laura A. Padgett, 32, of Alum Street, Weston, was charged with possession of a controlled substance/Methamphetamine by Tpr. FC Z.T. Cooper, WVSP, on March 19.
On April 25, Padgett pleaded guilty before Magistrate Gissy. She was assessed a fine of $100 and court costs of $160.25.
Jimmie D. Miller, 34, of Upper O’Brien Road, Frametown, was charged with domestic assault by Ptlm. R. Watson, WPD, on March 28.
On April 25, Miller pleaded guilty before Magistrate Gissy. He was assessed court costs of $160.25 and received credit for 28 days spent in jail prior to entering his plea.
Deborah  R. Harrison, 43, of Valley Hills Estate, Horner, was charged with battery by Ptlm. J.I. Minney, WPD, on April 15.
On April 25, Harrison pleaded guilty before Magistrate Clem. She was assessed a fine of $250 and court costs of $160.25.
Amber B. Eberly, 21, of Fairview Circle, Sutton, was charged with issuing a $227.30 worthless check to KBB Consignment on Dec. 3, 2016.
On April 24, Eberly pleaded no contest before Magistrate Gissy. She was assessed a fine of $10, court costs of $185.25 and was ordered to pay $232.20 in restitution.
Marianna Morin, 33, of Curry Ridge Road, Napier, was charged with third offense driving while license was suspended or revoked for general reasons by Deputy Z.M. Lopez, LCSD, on Jan. 23.
On April 19, Morin pleaded guilty before Magistrate Gissy. She was assessed a fine of $150, court costs of $160.25 and received a 60 day suspended jail sentence replaced with 60 days of home confinement, with credit for three days spent in jail prior to entering her plea.
