A Jane Lew man was sentenced to serve three days in jail after pleading guilty to a DUI charge.
Adam F. Stewart, 26, of Homeland Addition, was charged with DUI and possession of a controlled substance/marijauna following a single vehicle crash on May 12 on Rt. 19N near Jane Lew. Stewart had crashed his vehicle into a telephone pole. He registered a blood alcohol level of .154, nearly twice the legal limit to drive.
He was charged by Deptuty Z.M. Lopez of the Lewis County Sheriff’s Department and under a plea agreement with the state pleaded guilty before Magistrate Roger D. Clem, Jr. on June 19. As a result of the plea agreement the possession charge was dismissed upon motion by the state.
Stewart was fined $100, assessed court costs of $267.65 and was sentenced to serve 72 hours with credit for 24 hours served prior to entering his plea.
Other recent criminal dispositions handed down in Lewis County Magistrate Court included the following:
Rickina J. Smith, of Quarry Glen, Weston, was charged with shoplifiting 22 items at the Weston Dollar Store by Deputy B.D. Hendershot, LCSD, on June 10, and with the same offense at the Robin’s Nest Travel Center by Deputy A.J. Hummel, LCSD, on June 19. At the Robin’s Nest she allegedly stole $158.85 worth of items.
On June 21, under a plea agreement with the state, Smith pleaded no contest to the June 10 charge and the June 19 charge was dismissed by motion of the state before Magistrate Clem.
Smith was assessed a fine of $10 and court costs of $185.25 and was ordered to pay restitution to both the Dollar General and Robin’s Nest.
Jesse R. Johnson, 30, of West Seventh Street, Weston, was charged with failure to deliver vehicle title by Ptlm. J.I. Minney, WPD, on Feb. 16.
On June 19, the charge was dismissed upon motion by the state before Magistrate Michael R. Gissy with the notation that the title was delivered.
Sean E. Hohan, 29, of McCormick Drive, French Creek, was charged with three counts of possession of a controlled substance; marijuana, methamphetamine and a pill marked TAVA, by Deputy Z.M. Lopez, LCSD, on March 3.
On June 19, under a plea agreement with the state, Hohan pleaded guilty to one possession charge and the other two were dismissed upon motion by the state before Magistrate Clem. He was assessed court costs of $160.25 and received a suspended six month sentence replaced with one year of probation to include participation in the Community Corrections Program with the sentence being deferred.
Christopher M. Carpenter, 39, of Court Avenue, Weston was charged with petit larceny of a shirt from the Weston Dollar General by Cpl. L.D. Mohr, WVSP, on May 10.
On June 19, Carpenter pleaded guilty before Magistrate Clem. He was assessed court costs of $160.25, was ordered to pay $10 in restitution, and was given credit for 13 days spent incarcerated prior to entering his plea as jail time.
Matthew J. Duncan, 21, of South Main Street, Weston, was charged with improper vehcile registration, no vehicle insurance and driving while license was suspended or revoked for general reasons by Deputy Z.M. Lopez, LCSD, on Nov. 14, 2017.
On June 13, all charges were dismissed upon motion by the state before Magistrate Gissy with the notation that the dismissals were part of a global plea agreement reached in Lewis County Circuit Court.
Brenda D. Metz, 42, of Lenden Lane, Jane Lew, was charged with obstructing the police and driving while license was suspended or revoked for DUI by Deputy Z.M. Lopez, LCSD, on April 13.
On June 14, under a plea agreement with the state, Metz pleaded guilty to the driving revoked charge and the obstructing charge was dismissed upon motion by the state before Magistrate Gissy.
She was assessed a fine of $100, court costs of $160.25 and received a 30 day suspended jail sentence replaced with six months of probation.
Janal Nay, 47, of Broad Run Village, Jane Lew, was charged with failure to cause child to attend school by LC Schools Attendance Director Randall Myers on Feb. 1.
On June 18, Nay pleaded guilty before Magistrate Gissy. She was assessed court costs of $160.25 and will pay a fine of $50 should the child have any unexcused absences during the next 60 school days.
Ethan M. Osborne, 27, of Grassy Meadows Road, Alderson, was charged with domestic battery and destruction of property by Ptlm. B. Newbrough, WPD, on March 21.
On June 15, the domestic battery charge was dismissed upon motion by the state before Magistrate Gissy with the notation that the dismissal was not part of any plea agreement but was at the discretion of the state.
Osborne pleaded guilty to the destruction of property charge and was assessed a fine of $50, court costs of $160.25 and was ordered to pay the victim $350 in restitution for a destroyed cell phone.
Patricia A. Haggarty, 55, of LB Elliot Road, Weston, was charged with DUI by Sgt. E. Riddle, WPD, on Oct. 23, 2017.
On June 14, the charge was dismissed after Haggarty successfully completed the terms and conditions of deferred sentencing handed down in December of last year. She was assessed court costs of $215.25.
