Grand Jury Defendants Arraigned


Multiple defendants appeared in Lewis County Circuit Court Friday, March 10, for arraignments following their Grand Jury indictments last week. Cases were divided between the two Circuit Court judges.
Judge Jacob Reger
Reger set pre-trial hearings for the following cases at 9 a.m., June 7, with jury selection at 9 a.m., June 12 and the trials for 9 a.m., June 26, unless otherwise noted. Defendants entered not guilty pleas.
-Winford McCourt was
arrested in December, 2016, by Lewis County Sheriff’s deputies on a first degree arson charge.McCourt is being held at Central Regional Jail.
-Mitchell Bryant Smith was indicted on two counts delivery of a controlled substance both felonies, one count possession of a controlled substance, and one count possession of a controlled substance, both misdemeanors. However, his trial date was set instead for 9 a.m., June 13.
-Charles Dean was indicted on one felony count of driving with a revoked license, DUI—third offense. He was arrested on Dec. 21, 2016. His pre-trial hearing is June 8 and trial date is June 15, both at 9 a.m.
-Travis Hayhurst was indicted on one count of the solicitation of a minor, one count of solicitation of the minor by traveling to engage the minor in prohibited sexual activity, both felonies; and one count of sexual abuse in the third degree, a misdemeanor. His trial is slated for 9 a.m., June 19.
-Corey Bailey was indicted on one count grand larceny and one count conspiracy to commit grand larceny. His trial is set for 9 a.m., June 21.
Judge Kurt Hall
In the cases handled by Hall, pre-trial hearings were set for the morning of May 4, and jury
selections for May 15, with trial dates to follow after the jury selection is completed, unless otherwise noted. Defendants entered not guilty pleas.
-Emmanuel Phifer, Nathaniel Jones and Demius Jones each were indicted on two counts of the fraudulent use of an access device, accompanied by two counts of conspiracy to commit the alleged crime, as well as one count of attempting to obtain money, property and services by false pretenses, and one count of conspiracy to commit the alleged crime. They were arrested on Dec. 23, 2016. Additionally, Demius Jones is facing a misdemeanor for allegedly obstructing an officer.
-Jeremy Perry was indicted on two counts of grand larceny, one count of conspiracy to commit grand larceny, one count of destruction of property (misdemeanor), one count petit larceny (misdemeanor), one count of destruction of property (misdemeanor), one count of possession of a controlled substance with the intent to deliver, four counts of entering a building other than a dwelling, four counts of conspiracy to enter the previously noted building, as well as two additional separate, but identical counts each of the entering and conspiracy charges.
-Tiffany Tomaro was indicted on one count of grand larceny, one count of conspiracy to commit grand larceny, one count of entry to a building other than a dwelling, one count of conspiracy to commit entry of the building, and one count possession of a controlled substance with the intent to deliver.
-Robert Allman III was indicted on one count of fleeing with reckless indifference.
