DUI Cases Dominate Magistrate Court

Several DUI cases were before the Lewis County Magistrates recently, and dominated decisions handed down in court by Magistrates Roger D. Clem, Jr. and Michael R. Gissy.
Dale H. Kewitz, 56, of Horn Creek Road, Coxs Mills, was charged with DUI and leaving the scene of an accident by Cpl. E. Riddle, WPD, on Feb. 13, 2016.
On April 20, under a plea agreement with the state, Kewitz pleaded no contest to reckless driving and the DUI and leaving the scene of accident, charges were dismissed upon motion by the state before Magistrate Clem.
For reckless driving, Kewitz was assessed court costs of $160.25 and received a 10 day suspended jail sentence replaced with one year of probation.
Tracy N. Beckner, 47, of Riverside Drive, Richwood, was charged with DUI of a controlled substance by Deputy E.W. Clark, LCSD, on May 19, 2016.
On April 18, under a plea agreement with the state, Beckner pleaded guilty to reckless driving and the DUI charge was dismissed upon motion by the state before Magistratre Clem.
On the reckless driving charge, Beckner was assessed court costs of $160.25 and received a five day suspended jail sentence replaced with six months of probation.
Abbie K. Chapman, 27, of Riverdale Road, Clarksburg, was charged with DUI by Deputy E.E. Carpenter on June 29, 2015.
On April 18, the charge was dismissed upon motion by the defense, without objection from the state before Magistrate Clem. Chapman was assessed court costs of $240.25.
Lisa D. Hall, 47, of Candle Drive, Horner, was charged with DUI by Cpl. E. Riddle, WPD, on Feb. 19.
On April 18, Hall pleaded guilty before Magistrate Clem. She was assessed a fine of $100, court costs of $235.25, and received a 48 hour suspended jail sentence replaced with six months of probation.
Charles E. Posey, Jr., 37, of Riverside Drive, Weston, was charged with DUI by Tpr. M. Denison, WVSP, on April 15.
On April 17, Posey pleaded no contest before Magistrate Gissy. He was assessed a fine of $100, court costs of $235.25, and received a seven day suspended jail sentence replaced with 30 days of probation.
Jared L. Singleton, 36, of Glady Creek Road, Ireland, was charged with DUI by Deputy Z.M. Lopez, LCSD, on March 4.
On April 13, under a plea agreement with the state, Singleton pleaded guilty to reckless driving and the DUI charge was dismissed upon motion by the state before Magistrate Gissy.
On the reckless driving charge, he was assessed a fine of $25 and court costs of $160.25.
Cody D. Montgomery, 25, of 4B Trailer Court, Weston, was charged with driving while license was revoked for DUI by Deputy Z.M. Lopez, LCSD, on Feb. 1.
On April 13, Montgomery pleaded guilty before Magistrate Gissy. He was assessed a fine of $100, court costs of $160.25, and received a 30 day suspended jail sentence replaced with six months of probation.
Terry L. Lunsford, 30, of Alum Fork Road, Camden, was charged with second offense driving while license was revoked, obstructing and obstructing an officer by Cpl. D.A. Lothes, WPD, on Feb. 20. He was charged with third offense driving while license was revoked by Deputy Z.M. Lopez, LCSD, on March 24.
On April 18, under a plea agreement with the state, Lunsford pleaded guilty to obstructing and the March 24 third offense driving revoked charge and the Feb. 20 driving revoked charge was dismissed upon motion by the state before Magistrate Clem.
On the obstructing charge, he was assessed court costs of $160.25 and received a 30 day suspended jail sentence replaced with 30 days of home confinement.
On the third offense driving revoked charge, he was assessed a fine of $150, court costs of $160.25, and received a 60 day suspended jail sentence replaced with 60 days of home confinement, for a total of 90 days home confinement on both charges.
Donna Collins, 42, of Old Rt. 33, Weston, was charged with unlawful taking of a vehicle by Tpr. V. Pyles, WVSP, on Jan. 18.
On Jan. 21, Collins pleaded guilty before Magistrate Clem. She was assessed court costs of $160.25 and received a six month suspended jail sentence replaced with one year of probation.
On March 29, her probation was revoked and she was given three months of home confiement.
Jerry L. Steed, 37, of West Second Street, Weston, was charged with two counts of domestic assault by Sr. Tpr. F.J. Turansky, WVSP, on April 11.
On May 11, under a plea agreement with the state, Steed pleaded no contest to one count and the other count was dismissed upon motion by the state before Magistrate Gissy.
Steed was assessed court costs of $160.25 and received a six month suspended jail sentence, with credit for 25 days served, with the remainder replaced with one year of probation.
Deidre Blake, 41, of Pricketts Creek Road, Fairmont, was charged with possession of a controlled substance/methamphetamine by Prosecuting Attorney C. Flanigan, on May 8.
On May 11, Blake pleaded guilty before Magistrate Gissy. She was assessed court costs of $160.25 and received a 120 day jail sentence with credit for 120 days served in connection with a felony charge.
John W. Smith, Jr., 39, of Dillaway Street, Parkersburg, was charged with felony grand larceny for taking a vehicle by Sr. Tpr. F.J. Turansky, WVSP, on April 11.
On April 26, under a plea agreement with the state, Smith pleaded to the lesser misdemeanor offense of unlawful taking of a vehicle and the felony charge was dismissed upon motion by the state before Magistrate Clem.
Smith was assessed court costs of $160.25 and was given credit for time spent in jail.
